The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 448, 323, 365, 367, 504 and 506 of the IPC.

The prosecution case, as per the self statement of S.H.O., Town Police Station, Bettiah dated 05.06.2019 is to the effect that on the same day, the informant received an information that some miscreants on 03.06.2019 came at Sai Medico Shop and abused and assaulted the employee of the said shop, namely, Manoj Patel and Vishal Patel. It is alleged that when the video of the alleged occurrence got viral then the informant went to make enquiry when it was found that the petitioner and other co-accused persons actually assaulted the aforementioned medicine staff of

It is submitted by learned counsel for the petitioner that in the background of dispute with regard to return of the loan amount, some scuffle took place and the person who is alleged to have been assaulted, received simple injury. A statement has been made in paragraph no.3 of the petition that the petitioner is also made accused in one other case, in which he is on bail. Learned APP submits that the accusation against the petitioner is specific.

Considering the nature of accusation and the fact that the person, who is alleged to have been assaulted, has not lodged any case, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned CJM, Bettiah in connection with Bettiah (T) P.S. Case No. 434 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
