The petitioner seeks bail in connection with Barharia P.S. Case No. 99 of 2018 registered under Sections 272, 273, 308, 34 of I.P.C. and Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act-2016.

466.9 lts. of foreign liquor is said to have been recovered from straw room of Manoj Singh @ Langra and Somari Sah who managed to escape seeing the police party. Villagers divulged that the aforesaid accused persons sell out the liquor through the petitioner.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from

Patna High Court Cr.Misc. No.43849 of 2018(2) dt.20-07-2018 2/2 conscious physical possession of the petitioner. He has no concern with the seized liquor or with the place of recovery or with the aforesaid Manoj Singh @ Langra and Somari Sah or with any trade of liquor. He has been falsely implicated in this case due to dirty village politics. He was not apprehended on the spot. He has no criminal antecedent. He has been languishing in custody since 12.04.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise, Siwan in connection with Barharia P.S.
