Mr.Shailendra Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-08-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Kharik P.S. Case No. 94 of 2019, registered under Sections 147, 148, 149, 341, 323, 307, 325, 354, 504 and 506 of the Indian Penal Code.

The accusation is that in the evening of 04.05.2019, daughter of the informant aged about 18 years, came at her house from Basa and made complaint in weeping condition to the informant that petitioner caught hold her hand with bad intention. Thereafter, informant, Dayanand Thakur, along with villagers went at the house of petitioner and made complaint then six persons named in the F.I.R. including the petitioner

Patna High Court CR. MISC. No.47602 of 2019(2) dt.01-08-2019 2/2 started to abuse and scuffle. When the informant made protest then all started to assault, in which, Sunil Mandal, Anil Mandal, Madan Mandal, Amod Thakur and Bablu Mandal have sustained injury.

Learned counsel for the petitioner submits that due to some dispute, occurrence took place, in which, petitioner's side also sustained injury, regarding which, Kharik P.S. Case No. 95 of 2019 is also instituted on the basis of written report of father of the petitioner and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Naugachia, Bhagalpur, in connection with Kharik P.S. Case No. 94 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
