Petitioners in the present case are seeking anticipatory bail in connection with Patna Mahila P.S. Case No. 27 of 2019 registered for the offences punishable under Sections 376, 420/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
These petitioners are the parents of one Narendra Kumar @ Aman @ Gulam with whom the informant is said to have developed an intimate relationship while studying together. On going through the written statement giving rise to the present FIR it would appear that the son of the petitioners and the
Patna High Court CR. MISC. No.50350 of 2019(2) dt.22-10-2019 2/3 informant are said to have entered into physical relationship on their own understanding of marrying each other. There was no role of these petitioners to play at the relevant time, however, it is alleged at this stage that because the son of these petitioners is not marrying the informant, the informant is feeling cheated and has lodged the present FIR.
Learned Senior Counsel has further submitted referring to the statement made under Section 164 Cr.P.C. of the informant that in her statement also she has not made any allegation against these petitioners.
Learned A.P.P. for the State submits that so far as these two petitioners are concerned, there are no allegations that they had been in any way instrumental in the kind of relationship which the informant is said to have developed with the son of the petitioners.
Having heard learned Senior Counsel for the petitioners and learned A.P.P. for the State as also in the nature of allegations which are all against the son of these petitioners with whom the informant had established relationship under some understanding, let in the event of their arrest or surrender within a period of four weeks from today the petitioners abovenamed be enlarged on bail on furnishing bail bonds of Rs.
Patna High Court CR. MISC. No.50350 of 2019(2) dt.22-10-2019 3/3 15,000/- (fifteen thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna in connection with Patna Mahila P.S. Case No. 27 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. i.e.
(i) a condition that the person shall make himself available for interrogation by a police officer as and when required;
(ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
