JUSTICE ARUN KUMAR ORAL ORDER 13-07-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Special Case No. 1 of 2018 arising out of Kishanganj P.S.Case No. 40 of 2018 registered under Sections 22 and 23 of the Narcotic Drugs and Psychotropic Substance Act.

Allegation in brief is that from the hut of the petitioner, 1.100 Kg Ganja was recovered.

Submission is that so-called recovery is not from the conscious possession of the petitioner and the quantity of contraband material is small quantity and petitioner is in custody for last six months.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Md. Ashraf Hussain @ Shera is directed to be released on bail upon furnishing bail bond of Rs. 10,000/-

Patna High Court Cr.Misc.
