The petitioner apprehends his arrest in Sikarpur P.S. Case No. 517 of 2020, registered for the offences punishable under Sections 406, 409, 420 and 34 of the Indian Penal Code. Prosecution case in brief is that this petitioner along with co-accused persons committed irregularities in the execution and maintenance of record in connection with schemes under Chief Minister Rural Drinking Water Scheme and Chief Minister Rural Gali-Naali Pakkikaran Yojana relating to ward no. 13 and 14 of Gram Panchayat Rajpur Tumkadia, Narkatiaganj Block.

It is submitted that petitioner at the initial stage of execution of said scheme was posted as Panchayat Secretary of Rajpur Tumkadia Gram Panchayat. It is further submitted that on 29.06.2018, petitioner was transferred from Narkatiaganj

Patna High Court CR. MISC. No.60933 of 2021(2) dt.05-07-2022 2/2 Block by then District Magistrate, Bettiah, West Champaran. The petitioner was relieved on 07.07.2018 from Narkatiaganj Block and he submitted his joining on 09.07.2018 at Yogapatti Block. During the initial stage of these schemes petitioner disbursed money jointly with local Mukhiya and Management Committee. There is no allegation that this petitioner embezzled a single penny of public money at the time of disbursement of money to the Bank account of Ward Implementation and Management Committee. Petitioner claims clean antecedents.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Sikarpur P.S. Case No. 517 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
