The petitioner seeks anticipatory bail in connection with Nawanagar P.S. Case No. 196/2021, registered for the offences under Sections 341, 323, 354 (B), 379, 504 and 506/34 of the Indian Penal Code .
The learned counsel for the petitioner submits that the F.I.R. was lodged after three days, which has not been explained and co-accused person Bade Mishra @ Ratnesh Kumar has been granted bail vide order passed in Criminal Miscellaneous No. 52617 of 2021 and there is no specific allegation against the petitioner and the statement of the informant has not been recorded under Section 164 Cr. P.C.
Patna High Court CR. MISC. No.61121 of 2021(2) dt.07-06-2022 2/2 Learned Additional Public Prosecutor opposes the prayer for anticipatory bail.
Considering the above submissions and the fact that the allegation against co-accused Bade Mishra @ Ratnesh Kumar is of similar nature who has been granted anticipatory bail by co-ordinate Bench, let the petitioner above named, in the event of his arrest/surrender within four weeks from today in the court below, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Nawanagar P.S. Case No. 196/2021, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Shailendra Singh, J) kamlesh/- U T
