The petitioner seeks bail in a case registered under Sections 143, 144, 323, 337, 341, 307, 504, 506/34 of the Indian Penal Code.

The prosecution case in short is that a dispute arose between the parties on the point of loading sand and in consequence thereof, the accused persons having armed with rod, sword and Lathi, assaulted the informant, as a result of which, he sustained injury.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 17-06-2019.

The injury on the side of the accused has not been explained by the prosecution. General and omnibus allegation has been made against the petitioner. No specific injury is attributed against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-X, Gaya in connection with Neemchak Bathani P.S. Case No. 70 of 2019.
