The petitioner filed this modification petition for modifying the order dated 15.10.2015 passed in Cr. Misc. No. 41446/2015 whereby the petitioner was granted anticipatory bail. The petitioner seeks extension of time to surrender in the court below. It is submitted that the petitioner belongs to Scheduled Caste and resides at Pune to earn his livelihood and he could not surrender within the stipulated time as he fell ill. I do not find any plausible explanation which prevented the petitioner to surrender in the court below within the stipulated time. It is a sheer fault on the part of the petitioner that he did not surrender in the court below within time. Considering the facts aforesaid, I do not find any

Patna High Court Cr.Misc. No.20886 of 2016 (2) dt.20-05-2016 2/2 good ground for extension of time to surrender in the court below. This application is, accordingly, dismissed.
