In this case, the petitioner is apprehending his arrest in connection with Tear P.S. Case No. 37 of 2019 registered for offences under sections 341, 323, 324, 307, 504, 506, 379/34 of the Indian Penal Code.

As per prosecution case on 5.6.2019 at about 8 A.M., the Informant was cooking food in her house, in the meantime, the accused persons Lal Saheb Singh (petitioner) and Nishant Singh came there and pressurized her to put her signature on the blank paper. When she refused then Nishant Singh gave Garasi blow on her head. On alarm, her husband and other relatives came there to save her but, the accused persons also assaulted the husband of the Informant with Lathi-Danda.

Looking to the entire facts and circumstances of the case as also the petitioner having criminal antecedent, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, the prayer for bail of the petitioner, above named, is rejected.

If the petitioner surrenders before the court below within a period of four weeks from today and makes a prayer for bail, the court below, without being prejudiced by this order, will pass orders in accordance with law expeditiously preferably on the same day of appearance of the petitioner.
