2/8 CRIMINAL MISCELLANEOUS No.49746 of 2025 Heard the parties.
2. The petitioner seeks bail in connection with Pakaridayal P.S. Case No. 35 of 2025 registered for the offences under Sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.
3. The petitioner is named in the F.I.R. and is in custody since 29.01.2025.
4. Allegation against the petitioner is to call the husband of informant from his home whereafter the dead body of the husband of informant was found. Informant raised suspicion that petitioner might killed her husband along with other coaccused persons.
5. Mr. Anshul, learned sr. counsel appearing on behalf of the petitioner submitted that save and except suspicion as raised by informant that her husband was called from home by petitioner, nothing incriminating surfaced during investigation. It is pointed out that interestingly during investigation informant herself found committing murder of her husband with Kundan Kumar, therefore supplementary charge-sheet was submitted by police arraying informant as one of the accused in this case. However, it is also conceded that police also submitted charge-
3/8 sheet against this petitioner and other co-accused persons as named by informant.
6. While concluding the argument it is submitted that, petitioner is a man of clean antecedent and moreover, investigation of this case has already completed, and as such, there is no chance of tampering with the evidence.
7. Learned APP duly assisted by learned counsel for the informant, while opposing the prayer for bail submitted that as per FIR deceased was found last seen with petitioner and moreover, he was called by the petitioner and other co-accused persons from home.

In view of aforesaid factual submission and by taking note of fact as FIR in issue prima-facie authored on the basis of suspicion, where during the course of investigation it appears that informant herself found committing murder of her husband for which separate charge-sheet has been submitted by police, coupled with the fact as petitioner remains in custody since 29.01.2025, accordingly above named petitioner, is directed to be released on bail in connection with Pakaridayal P.S. Case No. 35 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, East
