The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 323, 354 and 379 of the Indian Penal Code.

As per the prosecution case, this petitioner caught hold of the complainant took her to a field and made attempt to commit rape with her.

It is submitted that FIR has been lodged after a delay of seven days. Complainant and petitioner are own Gotia and land dispute is pending between them. Due to grudge this false and concocted case has been lodged against petitioner. Rest of

Patna High Court CR. MISC. No.52629 of 2022(2) dt.20-12-2022 2/2 the allegation are ornamental and only with a view to harass the petitioner. Petitioner claims clean antecedent. Considering the backdrop in which the alleged occurrence took place and clean antecedent, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Samastipur in connection with Complaint Case No. 65 of 2021 corresponding to T. R. No. 1019 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
