2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 341, 323 304(B)/34 of the Indian Penal Code.

3. It is a case of dowry death. Allegation is that petitioners along with other accused persons killed daughter of informant due to non-fulfillment of demand of dowry.

4. Learned counsel for the petitioners submits that petitioner No. 1 is devar and petitioner No. 2 is Nanad and petitioner No. 3 and they are victim of over implication.

Patna High Court CR. MISC. No.56827 of 2024(5) dt.28-02-2025 2/3 Specific accusation is against husband of the deceased. Petitioners are separate in mess and property and have got no concern with family affairs of the deceased. Further, learned counsel for the petitioner orally submits that husband of the deceased is already in custody . Petitioners claim clean antecedent.

5. However, learned A.P.P. for the State vehemently opposed the bail application .

Considering the aforesaid submission of learned counsel for the petitioner that the husband of the petitioner is already in custody , clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM 1 Patna City in connection with Malsalami P.S. Case No. 839 of 2023 , subject to the conditions laid down under section 438(2) of Code of Criminal Procedure .
