The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406 and 420/34 of the Indian Penal Code.

It is alleged that petitioner Manoj Mahto borrowed Rs. 10,000/- from the informant on the eve of death of his mother. Subsequently, he refused to return the same and assaulted the informant.

It is submitted by the learned counsel for the petitioners that other petitioners are family members of the petitioner no. 3 Manoj Mahto. Hence, without any accusation

Patna High Court Cr.Misc. No.11753 of 2015 (2) dt.23-03-2015 levelled against them, they have been named in the First Information Report.

Considering the nature of accusation, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P.S. Case No. 521 of 2013, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
