JUSTICE ARUN KUMAR ORAL ORDER 31-07-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Ishakchak P.S.Case No. 59 of 2018 registered under Sections 302 and 120B/34 of the Indian penal Code. Allegation in brief is that petitioner was married 13 years back with the deceased and on account of non-fulfillment of dowry, she was murdered by the husband and other family members.

Submission is that wife of the petitioner committed suicide as she had developed illicit relationship with one Shashi Bhushan Bharati who had also videographed the intimate act and used to blackmail her so on account of that she committed suicide and there is also evidence in the case diary that the petitioner's wife was chatting with the said boy on Whatsapp

Patna High Court Cr.Misc. No.45614 of 2018(2) dt.31-07-2018 2/2 and the postmortem report reveals that it's a case of hanging and not strangulation and out of this wedlock, petitioner has two grown-up children.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Rajeev Kumar Singh @ Rajeev Ranjan Singh @ Rajeev Singh, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Bhagalpur in connection with Ishakchak P.S. Case No. 59 of 2018. (Arun Kumar, J) sujit/- U T
