In this case, petitioners are seeking anticipatory bail in connection with K.Hat (Madhubani) P.S. Case No. 28 of 2015 for the offence instituted under Section 420/34 of the Indian Penal Code, Sections 13/18/18-I C/29(1)(C)(F) and 30(1) of the Insecticide (Germlate) Act and Section 7 of the E.C. Act. Allegation has been made that petitioners were involved in illegal manufacturing insecticide. Counsel for the petitioners undertakes that whenever the Police will call for the petitioners for interrogation, they will remain physically present there.

No.10346 of 2015 (4) dt.30-07-2015 2/2 Looking to the aforesaid facts and circumstances of the case, let the petitioners above named, be released on anticipatory bail in the event of arrest or surrender before the learned court below within a period of four weeks in connection with K.Hat (Madhubani) P.S. Case No. 28 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and also condition that whenever the Police will call for the petitioners, they will remain present for interrogation and also cooperate in the investigation. If they will not cooperate in the investigation, the Prosecution will file an application for cancellation of their bail and the court below will be at liberty to pass the order, including cancellation of their bail bonds.
