Petitioner, already in custody, seeks bail in connection with Bakhri P.S. Case No.266 of 2017, giving rise to POCSO Case No.8 of 2018 registered under Section 366(A) of the Indian Penal Code.

Allegation in brief is that the petitioner enticed away the minor daughter of the informant and took away to Punjab and kept her in confinement for 15 days and raped her several times and the girl was also recovered from possession of the petitioner.

Learned counsel for the petitioner submits that petitioner has falsely been implicated and the girl herself turned up and there is no medical report.

Patna High Court Cr.Misc. No.27389 of 2018(4) dt.10-07-2018 2/2 Having considered the recovery of the girl along with the petitioner and her statement regarding committing rape by the petitioner as well as assessment of her age as 16 years by the Magistrate, the prayer of bail of the petitioner is presently rejected.
