2. The petitioner seeks bail in connection with Alauli P.S. Case No. 238 of 2025 instituted for the offences under Sections 191(2), 191(3), 190, 194(2), 195(2), 109 of the Bharatiya Nyaya Sanhita, 2023.
3. Prosecution case, in short, is that on the alleged date and time when the informant along with police force was on patrolling duty, a quarrel broke out between two groups over alleged misbehaviour with a minor girl, leading to physical altercation. Police intervened and pacified the parties. It is further alleged that the ex-mukhiya instigated the public against the police force.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel for the petitioner submitted that general and omnibus allegation has been made against the petitioner. No specific overt act is alleged against the petitioner. Learned counsel further submitted that no police personnel has been injured in the alleged occurrence. Learned counsel for the petitioner further submits that at the time of scuffle, Sonu Kumar has sustained superficial injury and except that, none has received any injury. It has been submitted on behalf of the petitioner that the petitioner is in custody since 08.06.2025 and has two criminal antecedents.
5. Learned counsel for the petitioner further submits that the co-accused Sonu Kumar and Md. Imdad have already been granted bail by this Court vide orders dated 07.08.2025 and 06.08.2025 passed in Cr. Misc. Nos. 50541 of 2025 and 50978 of 2025 respectively.
6. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
7. Considering the aforesaid facts and circumstances of the case, there being no specific allegation against the petitioner, the period of custody undergone by the petitioner as
Patna High Court CR. MISC. No.49582 of 2025(3) dt.13-08-2025 3/3 also the prayer for bail being based on parity, this Court is inclined to grant bail to the petitioner.
8. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- ( Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Alauli P.S. Case No. 238 of 2025.
