1. Heard learned counsel for the petitioners and learned A.P.P. for the State. No one appears on behalf of the informant.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 87, 137(2), 2(35), 3(5) of the B.N.S., Section 3(i)(v)(s), (2)(va) of the SC/ST Act and Section 8 and 12 of the POCSO Act.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and are brothers and the informant alleges that her minor sister had gone to attend nature's call on 15.04.2024 at 2.30 P.M. but did not

No.49753 of 2026(2) dt.29-07-2026 2/3 return, during search Manish disclosed that she was kidnapped by the accused persons including the petitioners and Nitish had kept the victim at village Chamarbigha in the house of his aunt, hence he came to the village and the victim was recovered as Sheikh Abdulla fled leaving her.
4. Learned counsel for the petitioners submits that victim and Nitish were in love and they eloped. It is further submitted that no doubt in the FIR, it is alleged that victim is a minor but then victim had reached the age of discretion. It is also submitted that the victim came back and her statement was recorded under sections 180 and 183 BNSS, wherein she has not supported the case of the prosecution nor has alleged that she was exploited physically. It is also submitted that petitioner no.1 being brother of Nitish came to be implicated. It is next submitted that if privilege of anticipatory bail is granted, the petitioners will not abscond rather will cooperate in the investigation to prove their innocence.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks
Patna High Court CR. MISC. No.49753 of 2026(2) dt.29-07-2026 3/3 from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Islampur P.S. Case No.153 of 2026, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
7. However, it is made clear that in the event if the Investigating Officer of the case files an application before the learned trial court bringing to its notice that the petitioners despite giving assurance to this court are not co-operating in the investigation in that event the learned trial court shall be at liberty to cancel the bail bonds of the petitioners.
