Singh(App) ====================================================== CORAM: HON'BLE MR JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 23-05-2016 The petitioner apprehends arrest in Parsauni Police Station (PS) Case No 21 of 2016 instituted under Sections 272, 273 of Indian Penal Code and Section 47A of Excise Act. It is alleged that 20 bottles or beer were recovered from a room outside the house on 07.04.2016. Admittedly, the petitioner was not found there. Learned counsel for the petitioner submits that only to falsely implicate him, all this has been done who was not found in possession of the beer. However, he submits that the notification, enforcing prohibition, came to be known only on 06.04.2016 and the incidence is of 07.04.2016. Be that as it may, in the event of his arrest or surrender within a period of four weeks from today, the petitioner abovenamed shall be released on bail on his furnishing bonds of
Patna High Court Cr.Misc. No.21863 of 2016 (2) dt.23-05-2016 2/2 Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in Parsauni PS Case No 21 of 2016 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
