Mr. Anil Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 14-10-2025 Heard learned counsel for the petitioners, learned APP for the State and perused the case diary.

2. The petitioners seek bail in Shahkund P.S. Case No. 83 of 2024, instituted for the offences punishable under Sections 341, 323, 504, 506, 302, 120(B) and 34 of the Indian Penal Code.

3. The prosecution case, in short, is that the petitioners

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. Charge-sheet has been submitted in this case.

5. In Cr. Misc. No. 49991 of 2025, learned counsel for the petitioner also submits that the petitioner is second wife of the co-accused person and the allegation levelled against her is general and omnibus in nature. The petitioner has been implicated in this case due to family enmity and strained matrimonial relations with the deceased. It is further submitted that there is no any eye witness to the said occurrence and only on the basis of suspicion the petitioner has been arrested. The petitioner is in custody since 17.02.2025 and has got no criminal antecedent.

6. In Cr. Misc. No. 53078 of 2025, learned counsel for the petitioner also submits that the petitioner is husband of the deceased as also of petitioner of Cr. Misc. No. 49991 of 2025. The allegation levelled against the petitioner is general and omnibus in nature. The petitioner has been implicated in this case due to family enmity and strained matrimonial relations with the deceased. It is further submitted that there is no any eye witness to the said occurrence and only on the basis of suspicion

Patna High Court CR. MISC. No.49991 of 2025(3) dt.14-10-2025 3/3 the petitioner has been arrested. The petitioner is in custody since 10.01.2025 and has got no criminal antecedent.

7. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioners.

8. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioners, this Court is inclined to grant bail to the petitioners.

9. Let the petitioners be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) each with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Shahkund P.S. Case No. 83 of 2024, subject to the following conditions: (I) One of the bailors shall be own/close member of the family of the petitioners.

(II) The petitioners shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioners.
