JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-09-2019 The present application has been filed for modification of the order dated 30.08.2016, passed in Cr. Misc. No. 27074 of 2016 to the extent of extending the period of surrender and pray for regular bail.
The factual matrix of the case is that the petitioner, while working as a Manager in the Transport Company of the informant, misappropriated Rs. 23,64,851/-, though, he admitted to have misappropriated the short amount to the tune of Rs. 18,80,662/-.
The matter was referred to the Mediation and Conciliation Centre of the Patna High Court Legal Services Committe, but since the issue could not be resolved through the process of mediation, Cr. Misc. No. 27074 of 2016 was disposed
Patna High Court CR. MISC. No.43625 of 2018(5) dt.18-09-2019 2/2 of, vide order dated 30.08.2016, with observation that the it is a case for consideration of regular bail, if the petitioner surrenders within a period of six weeks.
Earlier similar prayer for extending the period of surrender was also made and the period of surrender was extended by three weeks, vide order dated 23.11.2016, passed in Cr. Misc. No. 49223 of 2016, but the petitioner could not surrender within stipulated period.
On the ground mentioned in the modification application, the period of surrender is extended by two weeks from the date of receipt/production of a copy of this order in connection with Siwan Town P.S. Case No. 139 of 2016, pending in the Court of learned Chief Judicial Magistrate, Siwan.
Accordingly, present modification application is disposed of.
