JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-07-2019 Heard learned counsel for the petitioners, learned counsel for the State and learned counsel for the University. The grievance of the petitioners in the present writ application is non-payment of salary for the period they worked. Learned counsel for the petitioners would submit that similar issue has been decided in C.W.J.C. No. 12657 of 2017 by this Court vide order dated 31.08.2018.
Without going into merit, the writ application is disposed of with a direction to the University to examine the
Patna High Court CWJC No.3818 of 2017(5) dt.30-07-2019 2/2 claim of the petitioners within a period of one month, if it is found that the petitioners have actually worked, the University shall ensure payment of salary to the petitioners. In the event, the University finds that the fund available with the University is not sufficient, the University may raise demand for release of additional funds from the State Government so that the payment may be made to the petitioners. In the event, demand is raised for release of additional fund enclosing a copy of utilization certificate for the fund released earlier, the State Government may release additional fund so that the payment to the petitioners may be made.
With the aforesaid, the present writ application stands disposed of.
