JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under sections 307/302 and other ancillary sections of the Indian Penal Code.

As per the prosecution case, the petitioner and other accused persons are alleged to have assaulted the father of the informant with rod, lathi etc causing his death. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He submits that as per the FIR, all the six accused persons including the petitioner assaulted the father of the informant but only one wound on the right side of the scalp of the deceased has been found by the doctor. Patna High Court CR. MISC. No.61339 of 2021(5) dt.26-04-2022 2/2 antecedent and he is in custody since 9.6.2021. Similarly situated co-accused have already been allowed bail this Court vide order passed in Cr.Misc.No. 1772/2022.

Learned counsel appearing for the State as well as the informant oppose the prayer for bail. They submit that there is direct and specific allegation that the petitioner also assaulted the father of the informant causing his death. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate V, Buxar in Rajpur Police Station Case No. 110/2021.
