JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 18.05.2020 This writ application has been placed before the Virtual Court by order of Hon'ble the Chief Justice. Today Mr. Ashutosh Ranjan Pandey, learned AAG 15 has informed this Court that all the payments as stated in paragraph '8' of the counter affidavit filed on behalf of the State have been made to the petitioner on 16.05.2020. Learned AAG 15, therefore, submits that now the writ application has become infructuous as all the admissible financial benefits have been paid to the petitioner.

Dr. Rajesh Kumar Singh, learned counsel for the petitioner has been facing some technical glitch in connecting through video but he has been contacted through mobile phone of the Bench Officer. Learned counsel accepts that the payment has been made but prays for keeping it open for the petitioner to raise his grievance regarding the claims on account of retirement benefit, if any remains unpaid.
Having heard learned counsel for the parties, this writ application is being disposed of in view of the categorical statements made on behalf of the State that all admissible dues have been paid to the petitioner on 16.05.2020. Still with a view to protect the interest of the petitioner, this Court grants liberty to the petitioner that in case any payment has remained due or he has any grievance with respect to the payment made to him, the petitioner will have liberty to submit a representation to the competent authority who will consider the same within a reasonable time and any other or further admissible amount shall be paid to the petitioner.
It is, however, made clear that the observations of this Court shall not give any fresh cause of action to the petitioner
Patna High Court CWJC No. 3770 of 2017 (6) dt.18-05-2020 3/3 and a fresh grievance not related to the present proceeding cannot be allowed to be raised in the garb of this order.
