JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-12-2022 Heard Mr. Jitendra Narain Sinha, learned Advocate for the petitioner and Mr. Ajay Kumar Jha for the State. The petitioner seeks bail in connection with Madanpur P.S. Case No. 141 of 2022 dated 28.03.2022 instituted for the offences under Sections 302/34 of the Indian Penal Code.

The petitioner is the father-in-law of the deceased. Though there is accusation against the petitioner also but, it has been urged that the deceased was residing separately with her husband as family property was partitioned in the year 2019 only.

It has further been submitted that the husband of the deceased is in custody since 07.04.2022.

The petitioner has been made accused in this case

Patna High Court CR. MISC. No.51423 of 2022(2) dt.22-12-2022 2/2 only because of his standing in special relation to the deceased. No specific accusation has been leveled against the petitioner.

Regard being had to the aforenoted facts namely that the husband of the deceased is in custody and that the petitioner has spent about eight months in custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 141 of 2022.

However, it is cautioned that the petitioner shall participate in the trial and in case it is found that he is tampering with the evidence or is threatening the witnesses or is causing the trial to be delayed, the bail granted to him would be rendered liable to be canceled.
