Mr.Ajay Kumar Jha ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 13-12-2022 Heard learned counsel for the petitioner, learned APP for the State as well as learned counsel appearing on behalf of the informant.

The petitioner apprehends his arrest in connection with Gopalganj Town P.S. Case No.336 of 2022, registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code.

The petitioner alongwith other co-accused persons are said to have assaulted the informant. It is alleged that the petitioner assaulted the informant by means of knife on his head causing bleeding injury.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as

It is further submitted that the petitioner is said to have assaulted the informant by means of knife on the vital part of the body, but from perusal of the impugned order, it is clear that the injuries are simple in nature. Learned APP for the State as well as learned counsel for the informant opposed the prayer for anticipatory bail of the petitioner by submitting that the allegation is specific against the petitioner.

Considering the fact that the injuries sustained by the informant are simple in nature, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P.S. Case No.336 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
