ANJANA MISHRA ORAL ORDER 29-08-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner has been in custody since 08.10.2015 in connection with Begusarai Town P.S. Case No. 534/2015 registered for the offences punishable under Section 414 of the Indian Penal Code and Sections 45/46 of the Prisons Act and Section 22 of the NDPS Act.
Learned counsel for the petitioner submits that while he was in custody in connection with Khodawandpur P.S. Case No. 71 of 2009, the petitioner was remanded in connection with the present case and since then, he has been languishing in jail. It is further submitted that only for the recovery of 19 packets of substance which allegedly looked like Ganja, the petitioner was
Patna High Court Cr.Misc. No.46060 of 2018 (2) dt.29-08-2019 2/2 remanded though the said recoveries were made from a room adjacent to the kitchen and not from the kitchen where the petitioner was working. It is further submitted that the petitioner has already been in custody for nearly three years in connection with the present case and in the main case, an Appeal had been preferred against the order of conviction and this Court has already granted bail to him in Cr. Appeal No. 1177 of 2016 (D.B.). Considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-1-cum-Special Judge, POCSO Act and NDPS Act, Begusarai, in connection with Begusarai Town P.S. Case No. 534/2015.
