2. The petitioner seeks regular bail in connection with Khushrupur P.S. Case No. 43 of 2025, dated 27.01.2025, instituted for the offences under Sections 191(2), 191(3), 190, 103(1) & 115(2) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.
3. The prosecution case is based on the fardbeyan statement of one Uday Singh recorded at N.M.C.H., Patna on 27.01.2025. It is alleged that the
Patna High Court CR. MISC. No.51660 of 2025(2) dt.11-08-2025 2/3 family members of the informant were attacked at their home by 23 FIR-named accused persons with deadly weapons. Co-accused Piyush Kumar, Pappu singh, Gautam Kumar and Rakesh Kumar fired from their katta. His son, namely, Amol Kumar was shot by one of the coaccused persons, namely, Gautam Kumar from his rifle. Aforesaid Amol Kumar had sustained a gunshot injury and died on the way to N.M.C.H., Patna for treatment.
4. It has been submitted on behalf of the petitioner that he is in custody since 12.03.2025 and has two criminal antecedents, wherein he is on bail.
5. It has further been submitted that the petitioner has falsely been implicated in this case due to earlier dispute and there is no specific allegation against him. The only allegation against the petitioner is that he was the member of the unlawful assembly.
6. The learned counsel for the petitioner has also submitted that one of the co-accused persons, namely, Naresh Singh has been granted regular bail by a co-
Patna High Court CR. MISC. No.51660 of 2025(2) dt.11-08-2025 3/3 ordinate Bench of this Court vide order dated 31.07.2025 passed in Cr. Misc. No. 49359 of 2025.
7. The learned A.P.P. for the State has opposed the prayer for bail of the petitioner.
8. Having considered the facts and circumstances of the case and the period of custody of the petitioner as also grant of bail to the other similarly situated accused person referred to above, let the petitioner, above-named, be released on bail on his furnishing bail-bond in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-Ist Class, Patna City, Patna, in connection with Khushrupur P.S. Case No. 43 of 2025.
9. The application stands allowed.
