ANJANA MISHRA ORAL ORDER 20-07-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Learned counsel for the informant is also present.

The petitioner has been in custody since 28.05.2018 in connection with Simari P.S. Case No. 101 of 2018 registered for the offences punishable under Sections 147, 148, 149, 114, 302, 504, 307 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that though there is allegation that the petitioner was present at the place of occurrence, no specific role has been assigned to the present petitioner. It is submitted that, at best, the petitioner can be treated to be a member of the crowd.

In view of the fact that no specific role has been attributed to the present petitioner for the firing which took place

No.42676 of 2018 (2) dt.20-07-2018 2/2 between the parties and that the petitioner has got no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, Buxar in connection with Simari P.S. Case No. 101 of 2018.
