JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-07-2019 This is an application for grant of anticipatory bail in connection with Tejpur P.S. Case No. 59 of 2019, disclosing offences under Sections 379/34 of IPC.

Allegation as per F.I.R. is that while the informant was going by motorcycle after collecting amounts from Fino Bank Collection Gunai Busahi village, his bag containing one Tab Printer, ID Card was snatched by some miscreants. Petitioner is not named in the F.I.R., later on, his name transpired in the confessional statement of the co-accused. Submission of the learned counsel for the petitioner is that except confessional statement, there is nothing against him. Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that the investigation is still going on.

Having heard both sides, in view of nature of

Patna High Court CR. MISC. No.47362 of 2019(2) dt.30-07-2019 2/2 allegation and investigation is going on, I am not inclined to grant privilege of anticipatory bail to the petitioner. He may surrender before the learned court below and make prayer for regular bail.
