Petitioner seeks bail in a case registered for the offence punishable under Section 379 of the Indian Penal Code. According to FIR, some unknown person stole away the motorcycle of the informant. The same was recovered from possession of co-accused Diwesh Ram. Name of the petitioner surfaced in the confessional statement of Diwesh Ram and thereafter from possession of petitioner, a stolen motorcycle was recovered which was of Bousi P.S. Case No. 43 of 2017. Submission is that the petitioner is still in custody in Bousi P.S. Case No. 43 of 2017 and co-accused Diwesh Ram has already been allowed bail by a Coordinate Bench of this Court vide order dated 15.12.2017 passed in Cr. Misc. No. 54815 of
Patna High Court Cr.Misc. No.44718 of 2018 (2) dt.01-08-2018 2/2 2017. The petitioner is in custody since 01.06.2017. Considering the entire facts, let the petitioner, above named, be released on bail on completion of investigation against the petitioner on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bousi Police Station Case No. 42 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
