1. Though, the present writ petition has been filed for removing the encroachment from the public land, appertaining to Khata No.3, Khesra No.875, admeasuring 11 Dhurs, siutated at Mauza-Gudara, P.S. Manjhaulia, District-West Champaran, however, the learned counsel for the respondents has submitted by referring to the counter affidavit, filed in the present case that the encroachment in question has stood removed, nonetheless, the learned counsel for the petitioner has controverted the same.

2. In view of the aforesaid, I deem it fit and proper to direct the District Magistrate, West Champaran at Bettiah to

Patna High Court CWJC No.12214 of 2024(4) dt.08-10-2024 2/2 inquire into the matter and in case encroachment in question is still existing, the same shall be removed, within a period of six weeks from today, by taking recourse to the due process of law.

3. The writ petition stands disposed off on the aforesaid terms.
