Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 323, 341, 379, 380 and 307 of the Indian Penal Code. It is alleged that the petitioner and others entered into the house of the informant to commit theft of the sale proceed of the Cow of the informant. This petitioner alleged to have assaulted with knife to the informant and the accused persons took away Rs. 30,000/- cash and clothes of Rs. 5,000/-.

It is submitted by the learned counsel for the petitioner that the accusation gets clouded as for the occurrence of 30.11.2013 the First Information Report was registered on 22.12.2013. The injury report reflects the

Patna High Court Cr.Misc. No.6553 of 2015 (2) dt.19-02-2015 marginal size injury caused by hard and blunt substance, when the petitioner alleged to have assaulted the informant with knife.

The aforesaid facts constitute a ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Gaighat P.S. Case No. 368 of 2013, pending in the court of learned Chief Judicial Magistrate, Muzaffarpur.

With this observation this application is disposed of.
