ANJANA MISHRA ORAL ORDER 18-08-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 04.10.2017 in connection with S.C. No.244/17, arising out of Kasim Bazar P.S. Case No.153 of 2016, registered for the offence under Section 302/34/120B of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the present petitioner has been falsely implicated in this case and, in fact, there is no eye-witness to the occurrence. He further submits that in connection with the present case, several other named accused persons have since been extended the privilege of bail. It is submitted that the petitioner is also named in the
Patna High Court Cr.Misc. No.47080 of 2018 (2) dt.18-08-2018 2/3 F.I.R., but in view of the indiscriminate firing made by all the accused persons, in which the petitioner's name has also figured, the main allegation cannot be attributed to any particular person. It is under such circumstances that other coaccused have been granted the privilege of bail by co-ordinate Benches as well by this Bench in Cr.Misc. No.45987 of 2018, vide order dated 14.08.2018.
Considering the aforementioned facts and circumstances and that the petitioner's case stands on similar footing, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 1st, Munger, in connection with S.C. No.244/17 arising out of Kasim Bazar P.S. Case No.153 of 2016, subject to the following conditions:
(1) One of the bailors will be his own blood relative, preferably, father, mother, brother, sister and/or his wife.
(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.
(3) The petitioner shall remain physically present in court on each and every date during trial and in the event of his
Patna High Court Cr.Misc. No.47080 of 2018 (2) dt.18-08-2018 3/3 failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.
(4) The petitioner shall co-operate with the investigation, if not already concluded, and make himself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail. (Anjana Mishra, J) PNM U T
