21.08.2015 This is an application for transfer of Case filed by Opposite Party No. 2 from the Court of Chief Judicial Magistrate, Purnea to the Court of Chief Judicial Magistrate, Katihar.
It has been submitted that it is a case of murder of a Lawyer and, therefore, no Lawyer at Purnea is ready to appear on behalf of the Petitioner.
On the last occasion, notices had been issued to the Opposite Party No. 2 but none appears on her behalf. Considering the reasonableness of the prayer, Purnea Sadar P.S. Case No. 276 of 2013 pending before
Patna High Court Cr.Misc. No.30612 of 2014 (3) dt.21-08-2015 the Court of Chief Judicial Magistrate, Purnea is transferred to the Court of Chief Judicial Magistrate, Katihar within a period of three weeks from the date of receipt of this order with due notice to the Informant/Prosecution.
The Court at Katihar in seisin of the case shall dispose of the case expeditiously without granting unnecessary adjournment to any party for which reason, he is directed to send a list of the witnesses fixing specific dates for production of the witnesses along with a copy of this order, to the Superintendent of Police, Katihar, and the Superintendent of Police, Katihar is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
The Application stands disposed off with the aforesaid observations.
