Mr. Manoj Kumar - 1, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 10-08-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Hayaghat Case No. 53 of 2017, registered under Sections 302/34 and under Section 120(b) of the Indian Penal Code. The accusation in brief is that all the FIR named accused persons assaulted the husband of informant, as a result of which he sustained injuries and succumbed during the course of treatment.

Learned counsel for the petitioner submits that there are four specifically named accused persons in the FIR alleged to have assaulted the deceased. The petitioner is not named in the FIR which is apparent from the FIR itself. The petitioner name transpired in the so called confessional statement of the coaccused made before the police and one co-accused namely

Patna High Court Cr.Misc. No.49552 of 2018(2) dt.10-08-2018 2/2 Sadanand Sada was admitted on anticipatory bail by a coordinate Bench of this Court vide order dated 20.04.2018 passed in Cr. Misc. No. 20698 of 2018. The petitioner has no criminal antecedent.

Having considered the aforesaid facts and circumstances of the case, the petitioner, namely Arun Sada, is directed to be released on bail furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Darbhanga, in connection with Hayaghat P.S. Case No. 53 of 2017.
