The petitioner seeks pre-arrest bail in connection with Sheohar S.C./S.T. P.S. Case No. 14 of 2015 registered under sections 341, 323, 354, 448, 504 and 506 of the Indian Penal Code and section 3(i)(x)(xi) of SC/ST (Prevention of Atrocities) Act. Regard being had to the serious nature of allegation that the petitioner not only entered into the house of the informant but also outraged her modesty and threatened her in connection with the case instituted for the murder of her son, I am not inclined to grant him pre-arrest bail.

Accordingly, the application preferred under section 438 of the Code of Criminal Procedure is, hereby, rejected

Patna High Court Cr.Misc. No.21058 of 2016 (2) dt.24-05-2016 with observation that in case the petitioner surrenders and seeks regular bail, the same shall be considered on its own merit without being prejudiced, in any manner, by the order of this Court. (Ashwani Kumar Singh, J) Amin/- U
