JUSTICE ARUN KUMAR ORAL ORDER 17-07-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Laheri P.S.Case No. 240 of 2017 registered under Sections 395 and 397 of the Indian penal Code and 25(1b)a/26/27 of the Arms Act. Allegation in brief is that 7-8 dacoits committed dacoity in the house of the informant.
Submission is that neither the petitioner was put on TIP nor any incriminating material was recovered from his possession and only his name was disclosed in the confessional statement of one Jitu Kumar and investigation has been complicated against the petitioner.
Having considered the aforesaid facts and circumstances, the petitioner, namely , Shankar Kewat @Shiv Shankar Prasad
Patna High Court Cr.Misc. No.42933 of 2018(2) dt.17-07-2018 2/2 is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nalanda at Biharsharif in connection with Laheri P.S.
