JUSTICE SATYAVRAT VERMA ORAL ORDER 28-01-2022 Heard learned counsel for the petitioners and learned APP for the State through video conferencing. The petitioners seek bail in connection with Kauwakol P. S. Case No.314 of 2021, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The learned counsel for the petitioners submits that the petitioners are in custody since 16.08.2021, they are persons with clean antecedent and charge-sheet has been submitted in the case.

Allegation is of recovery of 66.375 litre of foreign liquor from a Santro Car in which the petitioners are alleged to

The learned counsel for the petitioners submits that the petitioners are not the owners of the car and they had taken the car from their friend for going to relative's place and as such, they were not knowing what was kept in the car. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioners are in custody since 16.08.2021, they are persons with clean antecedent and charge-sheet has been submitted in the case, the petitioners, above-named, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IIcum-Special Judge, Nawada in connection with Kauwakol P. S. Case No.314 of 2021.

The application stands allowed.
