The petitioner seeks bail in Phulwaria P. S. Case No. 88 of 2019 instituted for the offence under Section(s) 435,436 and 504 of the Indian Penal Code.

Learned counsel for petitioner submits that petitioner and informant are brothers. There is land dispute between the parties on account of partition.

In the written report it is alleged that on the date of occurrence Tilak ceremony of the nephew of the informant was going on. The allegation against this petitioner is that he came and started abusing the informant. On protest, the petitioner assaulted the informant by means of bamboo stick and also set the house on fire.

Patna High Court CR. MISC. No.48882 of 2019(2) dt.13-08-2019 2/2 Learned counsel for petitioner submits that fire took place due to short circuit. The informant has not sustained any injury.

Petitioner is in custody since 23.5.2019 .

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM XIII, Gopalganj, in connection with Phulwaria P. S. Case No. 88 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
