JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-04-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,307,448,504,337 and 338 of the Indian Penal Code and section 27 of the Arms Act.
It is alleged that the accused persons came, abused the informant and pelted stones. Subsequently, they entered into the house and assaulted the informant and his son. It is alleged against the petitioners that they fired on the wife of the informant causing injury on her left leg.
Statement has been made at paragraph 15 of the petition that there is no injury report on record. It is submitted by the
Patna High Court Cr.Misc. No.11245 of 2015 (2) dt.24-04-2015 2/2 learned counsel for the petitioners that no injury was caused to the wife of the informant. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on provisional anticipatory bail for one month in the event of arrest or surrender before the learned Court below within a period of three weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Jamui in connection with Jamui P.S. Case No. 5 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. The learned court below will confirm the provisional bail of the petitioners if it is found that no injury has been caused to the wife of the informant.
