JUSTICE MUNGESHWAR SAHOO ORAL ORDER 02-09-2016 Learned counsels for the parties submitted that same matter has already been disposed of today in Civil Miscellaneous No.124 of 2016. The said civil miscellaneous application is filed by a tenant of another eviction suit on the ground of bonafide requirement and this civil miscellaneous application has been filed by the tenant of another eviction suit on the same ground. According to the learned counsels, therefore, the order passed in Civil Miscellaneous No.124 of 2016 shall govern this civil miscellaneous application also.

In view of the aforesaid submission of the learned counsels for the parties, it is made clear that the order passed by this Court in Civil Miscellaneous No.124 of 2016 (attached herewith) shall govern this civil miscellaneous application also. Accordingly, this civil miscellaneous application is also allowed. The impugned order is set aside and the court below is directed to

Patna High Court C.Misc. No.130 of 2016 (4) dt.02-09-2016 pass a fresh order according to the direction in the aforesaid civil miscellaneous application after hearing both the parties. (Mungeshwar Sahoo, J) Harish/- U
