JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-07-2018 Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 26.4.2017 passed in Cr. Misc. No. 18906 of 2017 on merit.
Submission of the learned counsel for the petitioner is that there is allegation of firing on the police party but nobody has received injury and another co-accused person has been granted bail by a Co-ordinate Bench of this Court vide order dated 26.4.2017 passed in Cr. Misc. No.18906 of 2017. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.43646 of 2018 (2) dt.25-07-2018 2/2 satisfaction of the learned Addl. District and Sessions Judge IInd, Rohtas at Sasaram in connection with Chutiya P.S.Case no.05 of 2012, with condition that of the bailors must be a government servant or people's representative and further he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.
With the aforesaid observation, this application is allowed.
