The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code.

As per the prosecution case, ten named accused persons as also ten others are said to have come variously armed and as a result of previous land dispute, the accused persons started to assault the informant and others. It is stated that Parshuram Singh (the petitioner) assaulted Subhash Patel on his head with a farsa.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The cause of false implication being land dispute would be evident

Referring to the injury report of the aforesaid Subhash Patel which is Annexure-3 to the petition, it is submitted that all the injuries have been found to be simple in nature. The petitioner, who has no criminal antecedent, is in custody since 12.6.2021 and chargesheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for about 10 months, not having any criminal antecedent, contents of the injury report of Subhash Patel (Annexure-3) together with chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Majhaulia P.S. Case no.278 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, District West Champaran.
