The petitioner is apprehending his arrest in connection with Konch P.S.Case No.197 of 2019 registered for offences punishable under Section 30(a) of Prohibition and Excise Act, 2018.

As per FIR, the petitioner is said to be carrying liquor on the motorcycle and seeing the police, left the liquor in the house of Ritik Choudhary (petitioner) and Karu Choudhary and fled away.

Submission of the learned counsel for the petitioner is that nothing has been recovered from his possession and he has falsely been made accused in this case as well as he has no criminal antecedent.

Heard learned A.P.P. , who has opposed the prayer for bail

Patna High Court CR. MISC. No.48708 of 2019(4) dt.01-10-2019 2/2 stating that the petitioner is named in the FIR and the seizure list also shows that the motorcycle of the petitioner was used in the occurrence.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, he may surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on the basis of materials available on the record without being prejudiced by the order of this Court.

With the aforesaid direction, this application is dismissed.
