The State of Bihar .... .... Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 27-06-2016 A supplementary affidavit has been filed on behalf of the petitioner, which may be taken on record.

Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 147, 148, 149, 323, 324, 307, 427, 379 and 504 of the Indian Penal Code.

Allegation against the petitioner is that during assault he gave a knife blow on the head of the brother of the informant. It is submitted on behalf of the petitioner that he has falsely been implicated in the present case. Both the parties are agnates. It is a case and counter case between the parties. From perusal of the injury report it appears that the nature of injury is simple. Hence, no offence under Section 307 of the Indian Penal Code is made out. As far as the case instituted by the petitioner is concerned, same is for offence under Section 302 and other allied Sections of the Indian Penal Code.

On behalf of the State and the informant, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

No.21706 of 2016 (3) dt.27-06-2016 2/2 above named petitioner, in the event of his/her arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Hilsa (Nalanda), in connection with Hilsa P.S. Case no. 82 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
