JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 26-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Khizersarai P. S. Case No. 39 of 2016 registered under Sections 47(a), 13(f) and 48 of the Excise Act and Sections 2(F)/ 3/5(B)/18 of Bihar Mahua Flower Act.

Regard being had to the seizure of certain quantity of illicit liquor and other articles used for preparation of illicit liquor from a house alleged to be in possession of the petitioner, I am not inclined to grant him pre-arrest bail. Accordingly, his prayer for grant of pre-arrest bail is rejected.

However, in case the petitioner surrenders and seeks

Patna High Court Cr.Misc. No.21573 of 2016 (2) dt.26-05-2016 2/2 bail, the same shall be considered on its own merit without being prejudiced in any manner by this order.
