Grievance of the petitioner in the present application is that despite passing of training examination in first attempt, the benefit of matric trained pay scale has not been extended to the petitioner.

The petitioner was appointed as Assistant Teacher in the year 1999. He completed training in 2001. He appeared at the examination conducted in 2004 and declared passed in the training examination. The respondents have formulated their

Patna High Court CWJC No.14836 of 2019(2) dt.24-07-2019 2/2 own scheme for grant of trained scale on passing training examination 2004.

Learned counsel for the petitioner submits that notwithstanding their own decision, the respondents are sitting tight over the matter and till date they have not taken any decision in the matter of grant of trained scale to the petitioner. Under the aforesaid circumstances, the writ petition is disposed of with direction to the District Programme Officer (Establishment), Arwal to take necessary corrective decision as the petitioner is entitled to such pay scale in terms of decision of the State Government.

Necessary decision in this regard may be taken by the respondent District Programme Officer (Establishment), Arwal within a period of sixty days from the date of receipt/production of a copy of this order.

With the aforesaid, the writ petition stands disposed of.
