Petitioner seeks bail in Birpur( Balua Bazar) P.S.Case No. 131 of 2021 registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.

As per F.I.R, on 22.04.2021 at 9.p.m when the informant was going to Forbesganj on the way, he saw all the F.I.R named persons assaulting Tausif @ Chand when the informant went to rescue, all the accused persons assaulted him and snatched his cash and mobile, as a result of which he sustained injuries.

Learned counsel for the petitioner submits that there is

Patna High Court CR. MISC. No.61698 of 2021(2) dt.15-02-2022 2/2 general and omnibus allegation and no specific overt act has been attributed against the petitioner. During course of investigation, it has came to light that it was co-accused Chunnu Rai, who assaulted Kaamil with axe on his head. Petitioner is in custody since 26.04.2021. Investigation is complete. Considering the aforesaid facts and circumstances as well as period of detention of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st Birpur in connection with Birpur ( Balua Bazar) P. S. Case No. 131 of 2021.
